• All versions of #freehawaiiphoto can be used for both commercial and non-commercial purposes

• No permission is needed to use #freehawaiiphoto (though attribution is appreciated and will allow us to promote your usage on this website and social media)

WHAT IS COMMERCIAL USAGE? 💴

Examples of Commercial Usage include the use of the Art to produce and sell merchandise product (t-shirts, books, prints, wallpaper, etc) embodying copies of the Art. Other commercial examples include publications of the Art in online and printed media, and use in ads and websites.

What is not permitted 👎

• #FreeHawaii can not be sold and/or minted as an NFT or in any other form without significant alteration

• #FreeHawaiiphoto can not be licensed or sub-licensed to a 3rd Party without significant alteration

What is SIGNIFICANT ALTERATION 🛠

The intent of Significant Alteration is to protect 3rd parties from purchasing or licensing the same image that is available here at no cost. It should be clear to the 3rd party that the version being sold, minted, licensed or sub-licensed is altered in a way that value has been added to the original piece. How to give attribution ✏️

Even though attribution isn’t required, Cath Simard Photography Inc. appreciates it as it provides exposure to their work and encourages others to use #FreeHawaiiphoto in their projects. Attribution can be best done by including the hashtag #freehawaiiphoto on social posts, tagging the artists social accounts (see links in footer), or mentioning the artist “Cath Simard” in any other format.

Cath Simard Photography Inc. grants you an non-transferable, irrevocable, nonexclusive, perpetual worldwide copyright license to download, copy, modify, distribute, perform, and use #FreeHawaii for free, including for commercial purposes, without permission from or attributing the photographer, starting on the date of the NFT purchase (“Effective Date”). This licence does not grant rights to any usage before the Effective Date. This license does not include the right to sell and/or mint #FreeHawaiiphoto as an NFT or in any other form without significant modification. This licence also does not include the right to sell, transfer, licence or sub-license to a 3rd party without significant modification.

Cath Simard Photography Inc. reserves the right to modify, amend, change or adapt this licence at any time. Any changes to this licence supersede all previous versions.
